{"created":"2023-05-15T13:50:55.207158+00:00","id":11929,"links":{},"metadata":{"_buckets":{"deposit":"dc342f5d-1421-4efe-86b0-e61b0e63ef96"},"_deposit":{"created_by":1,"id":"11929","owners":[1],"pid":{"revision_id":0,"type":"depid","value":"11929"},"status":"published"},"_oai":{"id":"oai:chuo-u.repo.nii.ac.jp:00011929","sets":["271:626"]},"author_link":["31225"],"item_10002_alternative_title_34":{"attribute_name":"タイトル(ヨミ)","attribute_value_mlt":[{"subitem_alternative_title":"ドウセイカンカップルガコヲモツケンリトフランスセイメイリンリホウカイセイヘノウゴキ"}]},"item_10002_biblio_info_7":{"attribute_name":"書誌情報","attribute_value_mlt":[{"bibliographicIssueDates":{"bibliographicIssueDate":"2019-03-30","bibliographicIssueDateType":"Issued"},"bibliographicIssueNumber":"4","bibliographicPageEnd":"188","bibliographicPageStart":"127","bibliographicVolumeNumber":"52","bibliographic_titles":[{"bibliographic_title":"比較法雑誌"}]}]},"item_10002_description_19":{"attribute_name":"フォーマット","attribute_value_mlt":[{"subitem_description":"application/pdf","subitem_description_type":"Other"}]},"item_10002_description_5":{"attribute_name":"抄録","attribute_value_mlt":[{"subitem_description":"　フランスにおいては，2013年5月に同性婚が合法化され，同時に同性間カップルが子を持つ権利についても法律で認められた。そのため，現在ではその議論の中心は同性婚自体ではなく，同性間カップルが子を持つ権利に移っている。このように，2013年の法律においては，確かに子を持つ権利についても認められたものの，生命倫理法は，人工生殖をなし得るカップルは異性間カップルに限るという立場を打ち出しており，同性間カップルが子をもうける手段として人工生殖という手段を用いることはできなかった。\n　このような法律間の齟齬は最近まで続いたが，2017年の大統領選の際に，現大統領のマクロン氏が人工生殖を女性一般に広げることに好意的な見解を公約において示して以来，一挙に生命倫理法改正への動きとなったものである。国の倫理検討委員会（CCNE）は，色々と検討すべき点はあると述べており，委員の少数派はなお慎重であるべき，という見解を述べてはいるものの，総論としては女性一般に医療補助生殖を拡大することに好意的な立場を示している。対する代理出産に関しては，一貫して合法化する意図がないという姿勢を崩してはいない。\n　国民のうちにも賛否両論がある。すなわち，改正の方向に賛成する者がいる一方で，このように医療補助生殖を認める範囲を拡大するならば，配偶子の不足の可能性も生じ，その結果，現在前提としている無償性の原則が崩れる可能性があることを懸念する者，また，配偶子の提供については匿名性の原則が支配しているが，この原則と，子が自己の出自を知る権利との関係も問題になると指摘する者等さまざまである。\n　本稿においては，CCNEの報告書や他機関の報告書，民間調査会社の様々な統計の結果を参照しつつ，同性間カップルが子を持つ権利に関する問題に対する国や国民の見解を明らかにするとともに，予定される生命倫理法改正の方向性を明らかにすることをその目的とする。","subitem_description_type":"Abstract"}]},"item_10002_full_name_32":{"attribute_name":"著者別名(英)","attribute_value_mlt":[{"nameIdentifiers":[{"nameIdentifier":"31225","nameIdentifierScheme":"WEKO"}],"names":[{"name":"RIKIMARU,
