内容記述 | In 2019, same-sex couples have filed complaints to sue against the government for not supporting their legal marriage. Under the current Japanese legal systems, same-sex marriage is interpreted to be illegal: although no written provision of the Civil Code or Family Register Act bans it explicitly, the word “[unit consisting of] a husband and wife” is practically interpreted to mean only union between one man and one woman, and same-sex couples are excluded from the definition of marriage in Japan. In truth, substantive values of marriage or even “the right to marry” is not explicitly provided in the Constitution of Japan but is open to interpretation of those statutes. In proceedings of same-sex marriage litigation above, petitioners challenge the constitutionality of these statutes substantially to exclude same-sex couples from legal marriage. Compared to the United States of America and Western countries, Japanese society can be characterized as more group-oriented as a whole. In Japan, the virtues of harmony and cooperation have been respected under the strong influence of the Confucian tradition. The concept of individual autonomy is not derived from Japanese culture. Thus, the problem would occur as to how full protection of individual rights can be realized while respecting the Japanese societal norms and tradition. It must have been a major innovation for Japan to introduce the concept of constitutional rights based on individualism in the Constitution of Japan. If same-sex marriage is deeply related to the values of a nation, the Japanese people must open their eyes to the Constitution. Even though the Constitution does not express concrete substance of marriage and even though there is a constitutional interpretation that the Constitution leaves to the representative government, the Diet, the people must be aware that this issue may touch upon the basic values defended by the Constitution of Japan. Through referring to and examining possible meanings of a leading case in the Supreme Court of the United States, this paper considers what and how the Japanese people should think about same-sex marriage issues after Japanese court decisions. |
