| 内容記述 | The COVID-19 pandemic has turned the world upside down. How we live, work, learn, and communicate with each other have been changed completely. Social distancing guidelines have led to a more virtual existence, both personally and professionally. The resolution of disputes is no exception. The practice of law needs to adapt to the ever-changing circumstances of society. For example, many dispute resolution forums now allow virtual hearings. The coronavirus pandemic requires courts, judges, lawyers, and others involved in the justice system, such as Alternative Dispute Resolution (ADR) practitioners, to reassess how they should operate in a rapidly changing environment. Online modes of dispute resolution, often referred to as ODR, are promoting resolution while maintaining social distancing. The shift from traditional court processes to an online mode has assisted the public, lawyers, and experts in accessing the justice system during the crisis. Many law firms and legal service providers have been forced to adopt cloud computing systems. A substantial number of progressive firms and solicitors have already started to make use of digital dictation, AI contract review software, and website chatbots. In courts, the use of disruptive technologies has raised questions as to whether outcomes generated by these innovations reflect the meaning of justice in its traditional sense. Despite the significant progress that courts have made to adapt an online model of delivery, significant concerns from an access to justice perspective remain. This article explores how courts and ADR institutions around the world have transitioned from face-to-face to online proceedings, supported by internet technology. It then investigates some of the latest developments in legal tech. Finally, it considers how courts, ADR forums, and legal services have adapted this new transition while maintaining their focus on access to justice. |
