内容記述 | It could happen that transgender people request legal recognition of their gender and changing their name from female to male or male to female to conform their physical appearance with their ID document. But the authority would not necessarily approve of it. The author made an investigation into four decisions of the Hungarian Constitutional Court in an effort of understanding of how it responds to such disputes. The 2001 decision, though by the former Constitutional Court, recognized transgender people to have the fundamental right to amend their gender and name. The 2018 decision, the petitioner of which was a foreign citizen, rejected the plea, it made a judgement, however, that lack of the law, which would make it possible for foreigners to change their gender and name, was against the Constitution( Fundamental Law),leaving the solution to the legislative body. The 2021 decision annulled the retroactive application of the amended provision of the Act on Registry Procedures, which made it impossible to amend legally the sex at birth. The 2023 decision considered the above-mentioned amendment not to be unconstitutional. According to the amendment, the sex at birth is determined by a primary sexual characteristic and a chromosome, so it cannot be modified. While there was no dissenting opinion against the name change right of transgender people in the 2018 decision, the 2023 decision made it impossible for them to change legally their gender along with their name.In this way, the Constitutional Court is depriving thousands of people of the opportunity to live their daily lives with documents that reflect their gender identity. The most persuasive motive of such a change in a short span of time by the Court is the ninth amendment to the Constitution in 2020, which refers to the notion of ‘sex at birth’. In my opinion, the Court is now of the view that it is natural that the constitutional notion made it impossible to recognize legal gender change. We may suppose that the Constitutional Court, like the Orbán administration or the main public opinion, steered itself in the direction of not the pro-EU policy but its own way based on so called Hungarian Christian tradition. | |||||||||||
