| 内容記述 | It has become common practice in Multilateral Environmental Agreements to establish mechanisms to improve compliance and implementation of the treaties, called compliance procedures/mechanisms. The Paris Agreement, adopted in 2015 and now serving as the international legal framework for addressing climate change, is also an example of such an environmental treaty. The procedures for compliance with the Paris Agreement are based on Article 15, but the article does not provide for a specific mechanism, leaving its elaboration to later processes. Ultimately, the substantive compliance mechanism and its operational rules were not finalized until 2022. This article provides an overview and analysis of the Paris Agreement’s compliance mechanism. It includes four types of procedures, all designed to facilitate compliance: a self-referral-type trigger, a review of compliance with specific procedural obligations, questions in cases of significant and persistent inconsistencies between information submitted by Parties and the guidelines of the Transparency Framework, and consideration of systemic issues. Finally, the article concludes with a brief discussion of the place of this mechanism in the Paris Agreement, issues of flexibility, and, in reflecting on the experience of the climate regime to date,future challenges. | |||||||||||
