| 内容記述 | In contrast to successive dynasties, which did not define “Killing Caused by Playing” as a capital offense, the Ming and Qing Code stipulated it as a crime punishable by strangulation.This was due to the emphasis on the fact that “Killing Caused by Playing” was an act that is dangerous enough to endure killing, but dares to do it, and thus kills a person. The commutation factor of the absence of a conflict situation, which “Killing Caused by Playing” had, did not affect the provision of the Code. However, emperors and bureaucrats were forced to be aware of this commutation factor in the trial. During the Kangxi period, “Killing Caused by Playing” cases were sometimes commuted in the trial. In the early Qianlong period, the distinction between the trial and the Autumn Assize was required, and individual commutations were restricted at the time of the trial. Whether or not to commute the sentence for “Killing Caused by Playing” was to be decided at the Autumn Assize. | |||||||||||
