| 内容記述 | Although it has been almost a quarter of a century since judicial reform in Japan, the civil justice system has not responded to judicial policy making or mass civil litigation. This article addresses the above issues in the field of legal theory. This article focuses on Francis McGovern, a fixer, made a significant contribution to Multi-district Litigation (MDL), which is practiced in the United States to resolve mass tort cases. By setting a new perspective on the activation of mass litigation, this article contributes to the realization of the paradigm aimed at judicial reform in the theoretical aspect. | |||||||||||
