| 内容記述 | The exhaustion doctrine is a theory that states that once the holder of a copyright or patent has sold a work or invention, the holder’s rights to that work or invention are limited to the act of resale. If exhaustion of rights is established, competition will arise between the rights holder and resellers. In this sense, there is an important relationship between the success or failure of exhaustion and competition. In Japan, the situation regarding international exhaustion is different for copyrights and patents. In the United States, by contrast, two Supreme Court cases have reached the same decision regarding international exhaustion. In this paper, I have examined the significance of the exhaustion doctrine from the perspective of promoting free trade and sound economic activity, focusing on these two Supreme Court cases. Through this examination, I have sought to clarify issues such as the relationship between exhaustion and competition policy, how the determination of exhaustion affects the application of antitrust law, and how the differing understanding of international exhaustion between patent rights and copyright is positioned. |
