| 内容記述 | The purpose of this article is to review and discuss the history, content and significance of the Third World Approach to International Law. The Third World Approach to International Law is a school of critical international law that emerged with decolonisation. Its basic tenets can be summarised as follows. International law used to play a role in legally justifying the colonisation of Asian and African countries by European powers （later including Japan）. After the Second World War, there was a widespread decolonisation movement and many colonies achieved independence, but even after then, modern international law continues to exploit the Third World（ the collective term for the emerging group of States that have gained independence through decolonization）. The Third World Approach to International Law is a school of thought that recognises this, denounces international law that supports post-decolonial imperialism and envisages a fairer and more just international law that would replace such international law and serve the Third World countries and peoples. This paper confirms and examines the history, content and significance of such a third world approach to international law in general way. | |||||||||||
