/ \n\n　本資料は、承諾無能力者や限定的承諾能力者の承諾の有効性に関するシンポジウムにおける、質疑応答をまとめたものである。前半は、抜歯事例や筋腫事例およびエホバの証人の事例などを通して、患者の自己決定権の有り方について議論する。今回は、ドイツ判例の立場でもある、「患者の意思が優先されるので、治療行為は患者の承諾がなければ正当化されない』とする考え方を議論の基本的な出発点としている。その後、承諾能力の限界づけに関する諸学説の検討を通じて、承諾無能力者には「法的保護がない」という現状を明らかにし、いかにして解決を図るべきかを議論していく。この点について、論者によれば、「代諾」、「親との共同決定」および「拒否権」のいずれも実際的ではなく、承諾無能力者も、自己決定権を有し、人間の尊厳をも享有している人であるということから出発しなくてはならないから、承諾無能力者も何らかの方法でその承諾過程に「関与」することが必要である、と主張される。そして後半では、以上の議論をふまえ、とりわけ親権者の意思と子どもの意思とが乖離した場合に、医的侵襲へと向けられた意思決定プロセスに当該子どもをいかに「関与」させるべきかという問題について検討を加えている。","subitem_description_type":"Abstract"}]},"item_10002_full_name_32":{"attribute_name":"著者別名(英)","attribute_value_mlt":[{"nameIdentifiers":[{"nameIdentifier":"29215","nameIdentifierScheme":"WEKO"}],"names":[{"name":"Henning,
