内容記述 This article compares developments in Japan and the common law in a number of welfare and disability related areas. Specifically, the article compares the treatment under different regimes of persons with mental disabilities in electoral law tort law. The article argues that Japan, facing unprecedented demographic change and a legal tradition that is a hybrid of common and civil law, may provide inspiration for how legal systems in common law nations like Australia can deal with emerging issues surrounding age and disability. First, the article explores the common law model for tortious liability on the part of persons with mental disabilities and their carers. This model tends to attribute liability for torts to persons with mental disabilities, regardless of mental capacity. In contrast, the Japanese model, adapted from the German Civil Code, places responsibility on carers. The article compares and evaluates these different models, suggesting that neither model is ideal, but that developments in Japan focused on prevention and socialisation of accidents suffered or caused by persons with disability such as dementia provides ideas for potential solutions in other jurisdictions. Second, the article traces the abandonment in Japan of the link between adult guardianship and voting rights in the wake of a landmark district court case finding this link unconstitutional. This is compared to the Australian position, namely automatic disqualification from voting and enrolment for those of ʻunsound mindʼ, albeit subject to a self regulatory approach where typically a personʼs enrolment is cancelled on the basis of an objection made by a carer, usually motivated by a desire to relieve the burden of compulsory voting. The article discusses proposals to remove this disqualification and replace it with a system of regulation and supports featured in the reformed Japanese regime. The article argues that the Japanese solution is superior from a human rights perspective and encourages Australia to follow suit. The article concludes that these two comparative examples demonstrate that the increasing resolution in Japanese courts of disputes associated with changing attitudes to disabilities and a radically new demographic profile, combined with an arguably communitarian jurisprudence and community capacity to complement the law through supportive networks, makes Japan a valuable case study for other legal systems grappling with similar problems.
