| 内容記述 | This paper was written with the awareness of the issue that the measures to prevent illegal copying in the computer information transaction may serve as the self-help in the civil law. Therefore, the paper first considered the rationale of the self-help in conventional civil law theory, followed by confirmation of the requirements based on the cases. These examinations indicated that recent lower court judgments put more emphasis on social convention, in other words, whether the act in question was acceptable or not based on social convention”, than the requirements that had been clarified by Supreme Court rulings. This point is significant as self-help is principally prohibited and illegal in Japan, with exceptions when certain requirements are met. Such thorough studies to conclude that self-help in computer information transaction should be permitted under certain circumstances as well, however, only with some degree of strict requirements being provided and met. Granting of permission for preventive measure exceptions as self-help would be the best way at present both for businesses and consumers. | |||||||||
