The Directive was implemented by ‘The Commercial Agents（ Council Directive） Regulations 1993’ in England and by ‘The European Communities（ Commercial Agents） Regulations 1994’ in Ireland.\nThe Directive defines a commercial agent as follows: ‘Commercial agent’ shall mean a selfemployed intermediary who has continuing authority to negotiate the sale or the purchase of goods on behalf of another person, hereinafter called the ‘principal’, or to negotiate and conclude such transactions on behalf of and in the name of that principal. In order to have the commercial agency law applied to a person acting as an agent, they need to meet the requirements stipulated in this definition.
