Countouris教授（ユニバーシティ・カレッジ・ロンドン）が，2015年3月30日に行った講演をもとに執筆した原稿を，翻訳したものである。末尾には，理解に資するよう訳者による簡単な解説を付した。\n　本稿は，経済統合の先進例たる欧州連合（EU）において，越境的労働者配置という一時的な労働力移動をめぐって生じている，労働法の市場保護的な機能とサービス分野での市場開放の論理との間での先鋭な対立について論じ，原著者なりの解決方法が提案されているものである。具体的には，越境的労働者配置という形で自国内で働く労働者について，受入加盟国が自国労働法規範を適用することが，サービスの自由移動に反しないかが問題となっている。\n　本稿において原著者は，まず，こうした対立が生じる背景を，相互承認原則による規制レジームの輸出可能性によって説明する。次いで，そのような対立を調整するものとして，越境的配置労働者指令（PWD）が立法されたことを，しかしそうした趣旨を実務や欧州司法裁判所が歪めてきたことが論じられている。とりわけ欧州司法裁判所判例について原著者は，PWDを「ソーシャル・ダンピング」に適合的ないしそれを推進するものに変質させてしまったものと批判している。そこで原著者は，PWDの3つの「改革」案を示す。訳者からみて，原著者の主張のうち最も特徴的と思われるのは，「個人的労務提供者（personal work
