{"created":"2023-05-15T13:48:45.927729+00:00","id":8837,"links":{},"metadata":{"_buckets":{"deposit":"035af9fc-8179-40b8-a874-dc30d5baf295"},"_deposit":{"created_by":1,"id":"8837","owners":[1],"pid":{"revision_id":0,"type":"depid","value":"8837"},"status":"published"},"_oai":{"id":"oai:chuo-u.repo.nii.ac.jp:00008837","sets":["271:498"]},"author_link":["38982","29894","38980","32033","38983","38981"],"item_10002_biblio_info_7":{"attribute_name":"書誌情報","attribute_value_mlt":[{"bibliographicIssueDates":{"bibliographicIssueDate":"2016-12-30","bibliographicIssueDateType":"Issued"},"bibliographicIssueNumber":"3","bibliographicPageEnd":"150","bibliographicPageStart":"135","bibliographicVolumeNumber":"50","bibliographic_titles":[{"bibliographic_title":"比較法雑誌"}]}]},"item_10002_description_19":{"attribute_name":"フォーマット","attribute_value_mlt":[{"subitem_description":"application/pdf","subitem_description_type":"Other"}]},"item_10002_description_5":{"attribute_name":"抄録","attribute_value_mlt":[{"subitem_description":"パリ同時多発テロが発生した数日後の2015年11月16日，フランス共和国大統領は両院合同会議での演説において，国民を脅かすテロの脅威に対し国民の結集を呼びかけた。大統領は，テロとテロから生じるさまざまな行為に対する対策に必要な手段と措置の強化が重要であることを確認し，このような状況においても公共秩序と安全が維持されるよう，法的枠組の見直しが必要であると強調した。彼は，フランスが「戦争状態」にあるとしても，法治国家を尊重した上で，自衛のために力強く対処しなければならないと述べた。この演説は，二つの提案を明確にしていた。一つは，非常事態という特殊な状況を憲法に示す形で憲法を改正し，緊急の状況や例外的な事態に関する法的枠組を強化することが必要であること，もう一つは，11月13日の事件を受けて，国民社会を攻撃する者からフランス国籍を剝奪するという制裁を課す必要が生じたことである。2015年12月に首相から提出された憲法改正案には，非常事態と国籍剝奪，この二つの憲法規範化が盛り込まれていた。非常事態を憲法規範化する目的は，立法府のコントロールに基づきながらも，いくつかの基本的自由を制限し，場合によっては奪うことにもなる行政警察権限を執行府に自由に行使することを許す憲法枠組を定めることにあった。一般的に，今回の改正案のこの点に関しては，原則的にほとんど反対はなかった。他方で，国籍剝奪については，非常事態よりも多くの問題が提起され，賛同者と反対者の間に鋭い対立が生まれた。とりわけフランス社会を二分することになった問題は，国籍が剝奪される対象範囲についてであった。なぜなら，提出された憲法改正案では，テロ行為の犯人と認められ，有罪判決を受けた二重国籍者だけが国籍剝奪の対象とされていたからである。この要件は，平等原則に反すると考えられた。このことが，今回の憲法改正案を頓挫させる直接の原因となった。こうした憲法改正案が出てきた背景と失敗の原因を考察しながら，憲法改正に必要な要素を検討している。","subitem_description_type":"Abstract"}]},"item_10002_full_name_32":{"attribute_name":"著者別名(英)","attribute_value_mlt":[{"nameIdentifiers":[{"nameIdentifier":"38983","nameIdentifierScheme":"WEKO"}],"names":[{"name":"PHILIPPE,
