Förderung der Selbsttötung）」が2015年12月10日から施行された。本稿は，その動向を批判的に検討するものである。\n　当地において，この新条項導入以前，自殺関与は，法文上，禁止されていなかった。しかし，判例上，それを無に帰すかのような解釈論が展開され，実際上，自殺関与を巡る刑法上の取扱いは，動揺していた。このような法的状況を前提としていることもあり，今回の新規立法は，その論理構造に様々な矛盾を含んでいる点が批判されている。\n　また，この新規立法は，今後，ドイツにおける終末期医療の現場で，どのような波及的悪影響（ないしは萎縮効果）を及ぼし得るのかということも本稿では検討されている。\n　このように医師介助自殺に関する刑法的規制には多くの問題が伴う。そして，当該刑法的規制は，リベラルな法治国家の原則に反するものと批判されている。ここでいうリベラルな法治国家とは，ドイツ連邦通常裁判所が提示した言葉に従えば「全ての市民における居場所」として把握されるものである（BVerfGE 19, 206 [216]）。そのような姿勢を貫徹するならば，確かに，一定の生き方ないし死に方を「正しいもの」として掲げることは，断念されなければならない。このことが本稿では強調されている。\n　このドイツの新規立法により生じたとされる自殺の禁忌化がもたらす問題性は，自殺幇助罪規定を有する我が国にも同様に当てはめることが可能であろう。この新規立法に関して展開された生命倫理と法を巡るドイツの議論を検証することは，我が国において関連する論点への示唆を得るためにも，その意義が認められるように思われる。","subitem_description_type":"Abstract"}]},"item_10002_full_name_32":{"attribute_name":"著者別名(英)","attribute_value_mlt":[{"nameIdentifiers":[{"nameIdentifier":"38992","nameIdentifierScheme":"WEKO"}],"names":[{"name":"DUTTGE,
