| 内容記述 | In this article I explain about my experience and my concern about legal issues for foreign residents as an attorney in Japan. The purpose of this article is to have a broad understanding of the problems of foreigners living in Japan and to contribute to the internationalization that will continue to progress in Japanese society in the future. As long as living in Japan, the legal issues are the same for both foreigners and Japanese. However, there are many problems peculiar to foreigners. This article focuses on the differences. In the first place, there are legal issues that only foreigners have, like status of residence, refugee issues, governing law, issues of international jurisdiction, etc. Secondly, although the outline of basic legal issues is the same as that of Japanese people, there are some points that require attention to problems peculiar to foreigners. In criminal cases, the status of residence is always relevant when the accused is a foreigner. In the divorce issue, the issue of governing law, which country’s law applies to, is relevant to foreigners in the first place. I would appreciate if both Japanese and foreign readers will deepen their interest in and understanding of the legal issues of foreigners in Japan. |
