| 内容記述 | In order to predict the proper legal regime for the metaverse,the author,a cyberlaw specialist in Japan since before the millennium,first analyzes and reminds readers of some major works on cyberspace governance in the U.S.Thereafter,based especially upon works by Professors I. Trotter Hardy and Lawrence Lessig,the author finds out a principle that conventional real-world's law should be modified in case the environments of the new worlds (i.e.,cyberspace and metaverse) produce,quantitatively or qualitatively,special phenomena which are so different from the ones in the real world. For example,the fact that an ISP occupied an important role to protect free speech lead to the legislation of CDA Section 230. And the fact that cyberspace had allowed free-rider spammers to send unsolicited bulk email or unsolicited commercial email lead to enactment of anti-spam legislation. Thereafter,the author predicts that possible phenomena in metaverse such as attachment to avatars and immersion of the virtual worlds (VWs) would lead to applicability of some torts such as defamation or intentional infliction of emotional distress when avatars are injured by wrong-doers in the VWs. | |||||||||
